Harvard decision by eliminating diversity, equity, and inclusion programs, or risk losing federal funding. The letter represented the operational enforcement of Executive Order 14173, signed January 21, 2025, which required federal grant recipients to certify they do not operate DEI programs.
The letter created existential pressure for higher education institutions, which depend on federal research grants, student financial aid (including Pell Grants and federal student loans), and other federal funding streams. Universities faced a stark choice: dismantle diversity programs and certify compliance, or risk having their federal funding terminated. The certification requirement -- forcing institutions to affirmatively declare they had eliminated DEI programs -- functioned as a loyalty oath, requiring not just compliance but public ideological alignment.
The compliance pressure was amplified when the General Services Administration proposed on February 18, 2026, adding a formal DEI certification to the SAM.gov registration process required for all federal funding recipients, covering practices the administration defined as "discriminatory" including race-based scholarships, "cultural competence" requirements, and "diversity statements." The American Council on Education and other higher education associations characterized the requirements as "potentially existential" and urged GSA to rescind them, noting that many of the targeted practices remained legally required under state and local non-discrimination laws.
The preemptive compliance effect was significant: many universities dismantled DEI offices, eliminated diversity hiring programs, and scaled back equity initiatives before any legal challenge could succeed. Institutions faced potential False Claims Act liability for violating the certification -- penalties that could reach treble damages -- creating powerful incentives for overcompliance. A federal court in New Hampshire permanently blocked the Dear Colleague Letter in February 2026, but by that time the chilling effect had already reshaped the landscape of university diversity programming.
