DOJ Sues Penn State Over In-State Tuition for Undocumented Students, Its 27th Suit Against In-State Tuition Policies

The Justice Department filed a lawsuit against the Pennsylvania State University on November 5. In the complaint, the United States seeks to enjoin the university from enforcing its policy that provides undocumented students, including illegal aliens who reside in Pennsylvania, with in-state tuition rates, and from enacting any new tuition policies that favor undocumented students over U.S. citizens. DOJ’s release does not give the court or docket number.

DOJ says the suit brings its total to 27 lawsuits challenging in-state tuition for undocumented immigrants, and that six lawsuits in Texas, Kentucky, Oklahoma, Nebraska, Illinois and Kansas have resulted in favorable orders permanently enjoining similar laws.
