Judge Kasubhai Finds ICE Kept Making Warrantless Arrests in Oregon in Violation of His Order and an ICE Officer Lied in an Arrest Report
In an opinion and order filed 11/02/26 in M-J-M-A v. Wamsley (D. Or. No. 6:25-cv-02011), U.S. District Judge Mustafa Kasubhai ruled “Plaintiffs’ motion is GRANTED,” enforcing his preliminary injunction against warrantless ICE arrests in Oregon. Defendants had reported “only thirteen warrantless arrests” between February and August 2026; the court found that “ICE officers conducted significantly more than thirteen warrantless arrests in Oregon between February 2026 and August 2026” and that Defendants “violated the Court’s preliminary injunction order.”
He found that an ICE officer identified as J.G. “lied in an official record to facilitate the impression he was conducting a lawful warrant-based arrest,” and that the misconduct “calls into question the veracity of all I-213 forms completed by ICE officers in Oregon.” Of boilerplate language in arrest reports, he wrote: “This is sloppy work.” The order requires Defendants to produce, “for all arrests on or after September 1, 2026, all body worn camera footage of the arrest,” or state under oath that none exists. OPB reported the ruling the same day. Earlier testimony in Kasubhai’s court is at 2025-12-02–ice-agent-testimony-elite-quota-kasubhai-oregon.
