OCA-Asian Pacific American Advocates and Common Cause Sue DHS and USCIS in N.D. Cal. Over "Unlawful Voter Initiative" Targeting Naturalized Citizens

On 10/28/26 (filing date), OCA-Asian Pacific American Advocates, OCA-San Mateo, OCA-Sacramento and Common Cause filed a complaint for declaratory and injunctive relief in the Northern District of California (3:26-cv-12617) against the Department of Homeland Security, U.S. Citizenship and Immigration Services and their top officials.

The complaint says the “Unlawful Voter Initiative,” which USCIS adopted in August 2026, “systematically targets thousands of naturalized and derivative United States citizens” for voter eligibility investigations and tracking by the federal government. It alleges USCIS has reassigned hundreds of agents to investigate individuals flagged by DHS as potential noncitizen voters, and that agents who suspect noncitizen voting are told to create a TECS record for the individual. It says the agency describes its process as “supplemental magic.” It also alleges that the federal government presented Washington with a list of 405 individuals it believes to be noncitizen voters.
