Hennepin County Attorney Charges James O'Keefe and Cam Higby Over Polling-Place Videos
On Wednesday, Oct. 28, 2026, Hennepin County Attorney Mary Moriarty announced felony charges against James O’Keefe and Cam Higby for unlawful voting and identity theft, over videos they made at Minnesota polling places during the Aug. 11 primary. The men used names of registered voters, some deceased, to begin the vouching process, Moriarty said. They stopped short of signing an oath under penalty of perjury. Her office is charging them because, it says, the application is a “multi-step process.” These are charges, not findings. “It is not against the law to be performative,” Moriarty said. Moriarty said she’s unaware of any federal investigation into their attempt. O’Keefe called the charges retaliation for his report.
