Potter County GOP Sues in Amarillo to Bar Texas Certification Until Every Ballot Is Hand Counted

Plaintiffs, the Potter County Republican Party and its chairman, sued on Oct. 27, 2026 in the U.S. District Court for the Northern District of Texas, Amarillo Division, before Judge Matthew Kacsmaryk. The complaint asks the court to bar Texas county election officials from certifying the November 3, 2026 federal results until every paper ballot in every precinct is hand counted, and to confirm the results from that count if it differs from the machine tally. The theory is future risk. The complaint says it does not allege any past miscount, and it cites AI-enabled hacking of voting machines.

Parties. The only named defendant is the Potter County Elections Administrator, sued in her official capacity and as proposed representative of a defendant class of all Texas county elections administrators. No state official is named. Elias Law Group, for the DSCC and DCCC, moved to intervene as defendants on Oct 29, 2026. Its brief says plaintiffs’ class would not reach officials in every county, so the injunction would produce inconsistent procedures statewide, and says a hand count of millions of ballots cannot be done in Texas’s post-election timelines. A second motion to intervene came from Common Cause, the NAACP Texas State Conference, the League of Women Voters of Texas and MOVE Texas Civic Fund, with its supporting brief on Oct 31, 2026.

Schedule. The docket order of Oct 30, 2026 sets plaintiffs’ response before 5:00pm on Wednesday, November 4, 2026, with an intervenor reply due Monday, November 9, 2026. Both deadlines fall after Election Day. The order’s text does not say which motion the response answers, and the order itself is not in RECAP.

Limits. The complaint’s account of federal grant conditions and a DHS letter is plaintiffs’ allegation and was not checked here. Docket status is as of RECAP’s Oct. 31 sync and later entries may exist. See 2026-09-23–dscc-dccc-dga-sue-trump-admin-armed-agents-polling-places.
