Government Tells E.D.N.Y. Belgal Was Arrested Under a Warrant, Says He Withdrew His Bond Hearing Request

The government filed its brief and exhibits in Belgal v. Genalo, No. 26-cv-6607 (E.D.N.Y.), on October 23, 2026 (filing date). This is the government’s account, not a finding.

The brief says Belgal was arrested under a warrant that ICE issued on September 18, 2026, and that ICE was unable to serve the original warrant due to the active investigation into Petitioner’s arrest, so a second warrant was issued and served. It says he was admitted to MDC Brooklyn on October 9, 2026.

The government asks for dismissal for failure to exhaust, saying Belgal withdrew his request for a bond hearing on October 15, 2026. The brief recites the government’s account of Belgal’s criminal history; it is not reproduced here. The arrest record exhibit was filed under seal, and other filings on the docket, including bail and medical papers, are sealed and not in RECAP.
