TSE Electoral Inspector Cueva Gives Meta and X 24 Hours for Technical Reports on AI, Reach and Ads, With R$500,000-a-Day Fine Each; Defers Injunctions

On Oct. 22, 2026 (signed 21:08) Justice Ricardo Villas Bôas Cueva received AIJE 0603276-73 and ordered Meta and X, within 24 hours and under a fine of R$500,000 a day each for unjustified noncompliance, to file detailed technical reports. X: how Grok responds to equivalent prompts about the candidates and whether it generates electoral content unprompted. Meta: the causes of Oct. 19 automatic-translation episodes; the ordering of GIF and hashtag results on WhatsApp and Instagram, including outside vendors; whether three Flávio Bolsonaro-linked profiles (@flaviobolsonaro_go, @flaviobolsonaross3, @nikolasferreiras2) were eligible for non-follower recommendation and whether anything changed since Oct. 9; whether both campaigns’ ad accounts face the same review, delivery-limit and auction parameters and any specific rule since Aug. 16; the reliability of the coalition’s estimate of lost paid reach; and the human review and detection basis for the Oct. 22 removal of an Instagram teaser for the series “Revelando”. He declined a general rule of prior human review of removals of news and opinion content, reserved the injunction requests until the reports arrive, allowed the defendants five days to respond, and noted the Oct. 15 compensation questions remain with Justice Bellizze. Meta and X may file material under seal on reasoned request. Cueva wrote that receiving the case “não importa reconhecimento da veracidade das alegações”. The decision also describes the earlier orders: Oct. 15 in Rp 0602746-69 (referended Oct. 16) and Oct. 19 in AIJE 0603123-40 (special-treatment accounts of Nikolas Ferreira and Pablo Marçal).
