ProPublica Details Paxton's Anti-Abortion Legal Strategies and Their Spread Beyond Texas

ProPublica reported on October 19, 2026 that Texas Attorney General Ken Paxton “relentlessly tests the limits of the law and employs novel legal strategies to advance his goals”, and traces how two of them have travelled. Of Texas’s six-week ban, ProPublica writes that it remained in effect, “becoming the first enforceable six-week ban under Roe”, and that legislators in Idaho and Oklahoma subsequently passed similar laws. Of Paxton’s EMTALA suit, it reports that the ruling barred the federal government from pursuing cases against members of two anti-abortion medical organizations that had joined as plaintiffs, effectively exempting them from the federal guidance regardless of where they worked, and that the appellate win gave Idaho’s ban a lifeline.

ProPublica says Paxton’s national role would change if he wins his U.S. Senate race; Mary Elizabeth Castle of Texas Values says “He’ll have the ability to use some of the laws that he’s defended in Texas as influence to draft legislation in the U.S. Senate.” It reports that legal experts and advocates on both sides expect he could join colleagues pressuring the Food and Drug Administration to revoke its approval of mifepristone, and that Paxton recently said he was open to restrictions intended to prevent the loss of fertilized eggs. His litigation has also raised questions experts expect the Supreme Court to confront, per ProPublica. His Democratic opponent, James Talarico, has said that he supports restoring a federal right to abortion.
