Judge Bryan Threatens ICE With Sanctions Over Release-Order Violation in Saltos Instant Re-Arrest Case in Minnesota

Around noon on Oct. 19, Milton Saltos Velasquez was told he was being released from immigration detention per a judge’s order, MPR News reports. Judge Bryan wrote that ICE “failed to release” Saltos “thereby violating” his release order, and that ICE must release Saltos “immediately,” or the government could face sanctions. Saltos is one of seven instant re-arrest cases confirmed by MPR News, though immigration lawyers suspect there are more cases.

ICE officials previously told an immigration attorney that their lawyers identify good candidates for re-arrest, usually people who were arrested without warrants or probable cause in the first place. Saltos’s lawyer, Mostaghimi, said “It’s pretty abusive of the system.” A DHS spokesperson said that a judge’s release order “does not immunize the alien from immigration enforcement for all time.” The pattern follows 2026-09-25–ice-re-arrests-alejandro-inside-whipple-building-after-judge-ordered-release-minnesota; earlier Minnesota contempt threats are in 2026-03-05–second-minnesota-judge-threatens-contempt-ice-property.
