Arizona Attorney General Moves to Recuse Corporation Commission Chairman Myers From the APS Rate Case
The State of Arizona, represented by Attorney General Kristin Mayes’s office, filed a motion in the Arizona Corporation Commission’s Arizona Public Service rate case, signed on the 19th day of October, 2026 and docketed 10/19/2026, asking that Commission Chairman Nick Myers recuse himself from the final decision.
The State asks that Myers “immediately recuse” himself, and, in the alternative, that he stay out of deliberations on APS’s proposed formula rate mechanism. It says the Commission “will soon begin deliberating on a final order” and that recusal would still leave the Commission with a “quorum to deliberate and decide” on the application. It also asks the administrative law judge to add exhibits documenting Myers’s statements to the record or to take “official notice” of them.
The State bases the motion on public statements it attributes to Myers. It says Myers has made three public statements since April. It says that on April 6, 2026 he published an op-ed that the State characterizes as calling the State’s participation “beyond traditional legal participation,” and as urging an ethics investigation of the Attorney General; that in an April interview he said he was “disgusted” with her actions; that in a September 3, 2026 Commission release he said the Commission would continue to “utilize this mechanism and defend it in court” in reference to formula rate plans, after the hearings had ended; and that on October 12 he referred to her “twisted mind.” The State cites the Commission’s Code of Ethics, which says a commissioner should step aside when he or she “cannot be impartial.”
