All Parties Tell Judge AliKhan Consolidation Is Appropriate in Three D.D.C. Polling-Place Suits Against DHS and ICE

In a joint status report dated October 16, 2026, the parties in the three D.D.C. polling-place cases against DHS and ICE reported that, pursuant to the Court’s Minute Order of October 9, 2026, they had met and conferred on consolidation. All parties agreed that consolidation is appropriate under the Federal Rules of Civil Procedure, including because there are “extensive common questions of law and fact” among the cases. All parties further agreed that the separately represented plaintiffs reserve the right to file their own pleadings, and the government defendants reserve the same right for separate briefing. Defendants expressly reserve the right to request coordinated briefing schedules regarding any requests for emergency relief or discovery in this case.

This is a consent filing, not an order: the court has not yet ruled on consolidation. It answers the minute order recorded at 2026-10-09–alikhan-contemplates-consolidating-lulac-naacp-dscc-polling-place-suits-lulac-amends-to-add-doj-fbi, and the discovery fight at 2026-10-08–naacp-v-dhs-plaintiffs-seek-expedited-discovery-on-unlawful-voter-initiative-court-sets-response-dates now sits inside a case the government itself agrees should be joined.
