On the complaint’s file-stamp date the League of Women Voters, the Electronic Privacy Information Center and the League of United Latin American Citizens sued the Department of Homeland Security in the D.D.C. The defendants are DHS, Secretary Markwayne Mullin, ICE and its senior official David Venturella, Homeland Security Investigations and John Condon, and USCIS and Director Joseph Edlow. Counsel are Democracy Forward Foundation (Louis Katz, Ronald Fein, Brian Netter and others) and Citizens for Responsibility and Ethics in Washington.

The complaint alleges, as the plaintiffs’ claim, a policy it calls the Voter Data Collection Policy, under which DHS has obtained and is processing voter files from at least 47 states and combined them with commercially purchased data. The 47-state figure is the plaintiffs’ allegation, and the complaint cites an internal government email dated Sept. 1, 2026, as reported by Reuters on Sept. 24. It is not a count the complaint establishes from DHS records; the complaint also says “some version” of the files, and that at least 16 states voluntarily gave DOJ unredacted lists. The complaint quotes an internal HSI report (produced in redacted form under FOIA) as showing 50.6 million records ingested in a “DOJ Dataset Intake” and 48.4 million obtained by DHS Deputy Assistant Secretary for Election Integrity Heather Honey “through independent sources.” It names Accurint as one commercial source for “enrichment” and says the files cover every voter on a state’s rolls, not only suspected noncitizens.

The complaint pleads APA counts: action contrary to law and in excess of statutory authority; contrary to the Privacy Act; without observance of Privacy Act procedure (no system-of-records notice); without observance of Paperwork Reduction Act procedure; and arbitrary and capricious action. It asks the court to declare the policy unlawful, vacate and enjoin it, “delete and disgorge” the data, and bar internal use and sharing with DOJ.

The suit attaches to the SAVE sequence (2026-09-14–taylor-warns-save-tool-becoming-centralized-federal-voter-database, 2026-09-25–scotus-6-3-lifts-block-save-database-voter-citizenship-checks) and the HSI voter-file acquisition record (2026-08-25–ice-hsi-5m-rfi-recurring-national-voter-file-acquisition).
