On October 13, 2026, Minnesota filed its opposition to the federal motion to dismiss, plus a cross-motion for summary judgment, in State of Minnesota v. U.S. Department of Justice, No. 1:26-cv-01007-EGS (D.D.C., Judge Emmet G. Sullivan). The filings, with sworn declarations from BCA Superintendent Drew Evans and Hennepin County Attorney Mary Moriarty, are the first sworn account of how a short-lived evidence-sharing deal collapsed. CNN reported them on October 15.

Date kinds, because the tracker’s wording (“stopped sharing”) compresses them:

  • June 26, 2026 (agreement date). The U.S. Attorney’s Office (USAO) for Minnesota emailed a letter agreement for mutual sharing of all non-grand-jury evidence. Evans accepted. The letter conceded this “does represent a change to this office’s previous stance” (Opp. p. 28, quoting Moriarty Decl. Ex. 17).
  • Late June through July (delivery). The FBI handed the BCA Good’s vehicle and the gun used on Good; the USAO delivered four digital deliveries on Good, three hard drives on Sosa-Celis and two on Pretti, including body-worn camera footage and officer statements (Evans Decl. para. 39). PBS/AP reported the handover on July 13.
  • July 13, 2026 (announcement date). Moriarty publicly thanked the USAO. Per Evans, the USAO “ceased its cooperation and evidence sharing following that press conference” (para. 41). The filings give no precise stop date, and the CNN-reported “days later” is not in the Evans declaration.
  • Repeated “pause” assurances, then September 10, 2026 (decision communicated). The State says the U.S. Attorney told Moriarty several times that sharing was “paused” and that he was “optimistic” it would restart “soon.” On September 10 he said the pause was indefinite “in light of challenges with D.C.” and gave no timeline. A USAO Criminal Chief then refused a request to let investigators view unshared video, while confirming collaboration continues on unrelated matters (Opp. pp. 28-29, citing Moriarty Decl. paras. 33-38).
  • October 13, 2026 (disclosure/filing date) and October 15 (press pickup). The decision became public only through the filing; CNN’s story followed two days later.

Withheld, per Evans para. 42 (sworn): the cell phone of the agent who killed Good; Good’s clothing; recordings of interviews on the Good shooting; the firearms used by the officers who shot Pretti; the firearm taken from Pretti; the officers’ cell phones in the Pretti case; projectiles and casings from the Pretti scene; the recording of a statement by one of the officers who shot Pretti; and grand jury material on the Sosa-Celis shooting.

What the record does not show. The reason is attributed only to the U.S. Attorney’s own phrase, “challenges with D.C.” Evans swears no national-security or investigative-harm justification was ever offered. The Moriarty declaration and its 17 exhibits are not in RECAP, so the call details rest on the State’s brief characterizing it. No DOJ response was located. Premise correction: the tracker’s “stopped sharing … withholding firearms, cellphone data, physical evidence, and an officer’s statement” is accurate as to what is withheld, but the stop was not new on October 15; it dates to mid-to-late July, with the indefinite message in September. This is evidence that the July handover (see the March 24 lawsuit entry’s “Update”) was a partial, reversible concession, not a resolution.

Context. Federal motion to dismiss filed September 28; briefing runs to October 27 (docket order of September 17).
