Homeland Security Investigations agents searched the Washington, D.C.-area residence of Democratic Rep. Ilhan Omar early Monday morning. A Department of Justice spokesperson said HSI “executed a judicially authorized search warrant secured by the Department of Justice” as part of an ongoing federal criminal investigation. Border czar Tom Homan said, as ABC News reports: “I can confirm that a search warrant was executed this morning, signed by a judge. Department of Justice is leading the investigation along with Department of Homeland Security.” He added: “I won’t get into the specifics of the criminal investigation.” Omar wrote “I will not be silenced”; her spokesperson Jackie Rogers called the search an “outrageous abuse of power and an unprecedented escalation in the weaponization of federal law enforcement to target political enemies.” Omar has denied wrongdoing and, ABC reports, has not been charged with a crime.

What the investigation concerns rests on unnamed sources, and stays attributed. Sources told ABC News that the investigation relates to Omar’s immigration paperwork. NPR reports that one current official said the search is part of a multiyear probe that includes whistleblower complaints, and that a former official said the investigation deals with immigration fraud allegations. NPR also reports, citing sources not authorized to discuss the case, that senior DOJ leadership including Acting Deputy Attorney General Trent McCotter were consulted before the search and approved it.

Timing: ABC reports the midterm elections are 22 days away, with early voting starting in Minnesota later this week. The “60 days” figure comes from the outlets, not from a Justice Department text we have read: ABC writes that “the Justice Department’s practice has been to advise prosecutors not to take any overt investigative steps against members of Congress or candidates within 60 days of an election,” and NPR writes that the department “has had an internal rule that it shouldn’t publicly probe election officials or candidates within 60 days of Election Day,” adding that the rule “is not legally binding.” The Justice Manual page on protecting government integrity states: “Federal prosecutors and agents may never select the timing of any action, including investigative steps, criminal charges, or statements, for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party.”

This entry records the search and what officials and outlets say about it; it makes no finding about purpose.
