Judge Rochon Stays CBP's $20 Million LMD Ad Purchase Order in Common Cause v. DHS, Finds Plaintiffs Likely to Succeed
Judge Jennifer L. Rochon’s order in Common Cause v. Department of Homeland Security (S.D.N.Y.) is stamped Filed 10/11/26 (order filing date). Granting a temporary restraining order and a stay under the Administrative Procedure Act, it stays the purchase order entered into on or about September 20, 2026 (purchase order date) between Customs and Border Protection and LMD Agency, and stays OMB’s apportionment of $20 million for the advertisements that purchase order covers.
What the order does and does not say
The court found the moving plaintiffs “likely to succeed on the merits.” It states that “A full opinion shall follow shortly.” This entry therefore carries the order’s operative terms only; the reasoning is not yet published. The order is a preliminary ruling on likelihood of success, not a final merits holding.
What happened to the airings (reporting, not the order)
Trump posted on Oct. 5 (post date, per CNN) that “I have decided to do the Patriotic Ads, among others, and pay for them myself, and with money I raised for MAGA, Inc.” NPR’s analysis of AdImpact data reports nearly $22 million in taxpayer money spent to air the ads, and that nearly $10 million of that was spent after Oct. 5. A White House official told NPR that “The last PSAs paid for by the government aired yesterday evening.” AdImpact tracks airings; it is a third-party estimate and the ads were classed by the White House as public service announcements.
Research Gaps
- The written opinion Judge Rochon said would follow, and any appeal.
- The CBP-LMD award itself: see 2026-09-20–cbp-awards-lmd-agency-20m-national-media-campaign-contract-trump-ads-begin.
- Whether the stay was extended beyond the restraining order’s initial term.
