Judge AliKhan Contemplates Consolidating the LULAC, NAACP and DSCC Polling-Place Suits; LULAC Amends Its Complaint to Add DOJ and the FBI
In a minute order signed 10/09/2026, Judge Loren L. AliKhan wrote that the court is contemplating consolidation, under Rule 42(a), of the polling-place suits LULAC v. DHS, NAACP v. DHS and DSCC v. ICE (three cases in all), and ordered the parties in the three cases to meet and confer and file a joint status report with their positions on or before October 16, 2026. Nothing has been consolidated.
The LULAC plaintiffs filed a amended complaint on 10/07/26. Its caption adds the FBI and its director, Kash Patel, as defendants. The complaint alleges that the federal government may not send armed officers to polling sites, and that the defendants’ adoption of their respective Polling Place Policies violates 18 U.S.C. § 592 and Section 11(b) of the Voting Rights Act.
