ICE Agent Shoots Oscar Belgal in Marble Hill With His Child in the Car; Judge Later Bars Deportation

Plainclothes ICE agents shot Oscar Belgal in the neck on Oct. 8 in the Marble Hill neighborhood of the Bronx while his 5-year-old child was in the back seat of his car. ICE’s account, given by executive associate director Marcos Charles, is that Belgal “weaponized his vehicle” and drove at officers; officials described the wound as superficial. NYPD video shows agents approaching with guns drawn, which ICE’s account did not mention. His attorneys say in a habeas petition that at least seven shots were fired, that a bullet remains lodged in his neck, and that ICE did not prepare a Notice to Appear until Oct. 9, the day after the shooting. DHS alleges gang ties and a criminal history; his attorneys say he vehemently denies involvement with any gang or organized criminal organization. CNN reports it was the first shooting involving ICE agents in New York City during the current crackdown, and the Bronx District Attorney, Darcel Clark, is investigating.

On the Wednesday after the shooting, a federal judge ordered the government to explain why Belgal should not be released, barred his deportation or transfer outside New York City’s federal judicial districts, and gave prosecutors until Oct. 19 to respond.
