In a letter of supplemental authority to the Eighth Circuit in United States v. Simon, the appeal in the Minnesota voter-roll case, DOJ’s Civil Rights Division wrote on October 7, 2026 that, because the Supreme Court on September 25, 2026 granted the United States’ application for a stay of the district court’s order, the United States intends to resume using the SAVE system.

The letter points back to the United States’ Reply Brief, which noted that it had originally planned to use SAVE, and says the Department would not use the SAVE system pending the resolution of that aspect of the litigation. This is DOJ’s own description of its filings and of the Supreme Court’s order.

The Supreme Court’s stay is recorded at 2026-09-25–scotus-6-3-lifts-block-save-database-voter-citizenship-checks.
