All Three SDNY Public Charge Suits Go to Summary Judgment on a Spring 2027 Schedule; Still No Injunction Motion on Any Docket
Judge Ronnie Abrams signed identical case-management orders on October 5, 2026 (entered October 6) in all three S.D.N.Y. challenges to the expanded public charge rule. Each puts the case on a summary-judgment track: defendants produce the administrative record October 23, 2026; plaintiffs move for summary judgment December 11, 2026; defendants cross-move January 29, 2027; plaintiffs’ opposition and reply is due February 26, 2027; defendants’ reply is due March 12, 2027. The October 9 initial conference was adjourned in each. The rule has been operative since September 18; on this schedule no merits ruling can come before spring 2027.
What the dockets show (RECAP, last filing October 23, 2026)
- State of New York v. DHS, No. 1:26-cv-07978 (22 jurisdictions): scheduling order Dkt. 60; since then only appearances, pro hac vice orders, and on October 23 a Notice of Service of the Administrative Record (Dkt. 83).
- City of New York v. DHS, No. 1:26-cv-07982 (six municipal plaintiffs): scheduling order Dkt. 54; administrative record notice Dkt. 57, October 23.
- Make the Road New York v. DHS, No. 1:26-cv-08129 (filed September 17; Make the Road New York, New York Legal Assistance Group, African Communities Together, Association to Benefit Children; assigned to Abrams as related): scheduling order Dkt. 48; administrative record notice Dkt. 51, October 23. The complaint asks that the rule and the USCIS guidance be “declared unlawful, vacated, and set aside” under the APA (vacatur and injunctive relief); it does not itself move for interim relief.
No TRO, preliminary-injunction, or 5 U.S.C. 705 stay motion appears on any of the three dockets, and none is scheduled: the case-management plans route directly to summary judgment. The previously open question, whether a late PI motion followed the October 9 conference, resolves as no: the conference was adjourned and the court set a merits schedule instead.
Basis and limits. This is an absence finding from RECAP copies. Entries read were the docket lists and the full text of the scheduling orders and complaint; Dkt. 39 and 51 (Make the Road) and Dkt. 83 (states) are not in RECAP as documents, so their text was not read. A motion filed since October 23 would not show. Confirm on PACER before a published piece states the absence flatly.
