E.D.N.Y. Judge Finds ICE Officers Gave False Testimony and Falsified Records in Almonte v. Genalo, Grants Habeas Provisionally

In a habeas order in Almonte v. Genalo (E.D.N.Y.), the court wrote: “At the hearing, the officers proffered inconsistent, false and misleading testimony.” It also wrote that “ICE agents falsified official records trying to conceal their illegal actions, which included significant injury to a U.S. citizen.” The order lists “evasive and apparently perjurious testimony” that it says bears “all the hallmarks of coordinated fabrication,” and calls a statement in the arrest warrant “undeniably false.”

These are a judge’s findings in a provisionally granted petition. “Apparently perjurious” is the court’s hedge, not a perjury finding, and no sanction or contempt order is recorded here. The court ordered respondents to report within 21 days and said the failings fall within its powers “to impose sanctions,” to refer the matter or to use contempt. Whether respondents answered, or appealed, was not shown in RECAP when this was written. The officers the order names are not named here.
