Treasury Issues a GENIUS Act Interim Final Rule on State-Certification Review, Effective Immediately

The act. Treasury issued an interim final rule on behalf of the Stablecoin Certification Review Committee, setting the forms and procedures for the committee’s review of state stablecoin regulators’ certifications. The rule is effective September 30, 2026. It is procedural and is not an anti-money-laundering rule.

Context, checked as of the research pass on this entry. Searches of the Federal Register API (no key) found no final or interim final rule from FinCEN or OFAC implementing the Act’s anti-money-laundering and sanctions-compliance requirements. The comment-close date for the open AML rulemaking was June 9, 2026.

What the statute required. The Act directed the Treasury Secretary and each primary federal payment stablecoin regulator to promulgate regulations within one year of enactment. Enactment was July 18, 2025, so the rulemaking deadline was July 18, 2026, and it passed without a final AML rule. The Act takes effect on the earlier of 18 months after enactment or a set period after the primary federal regulators issue final regulations.

Baseline for comparing a future final rule. The FinCEN/OFAC draft carries the dates April 8, 2026 under Andrea M. Gacki, Director of FinCEN, and Bradley T. Smith, Director of OFAC. Its terms: a suspicious-activity-report threshold of $5,000, a civil penalty ceiling of $100,000 per day for sanctions-program violations, and an effective date 12 months after issuance of final rules.
