Judge Xinis Orders 30 Days' Notice Before DHS Activates State Citizenship Lists Portal

At a hearing on September 25, 2026 on the Electronic Privacy Information Center’s motion for partial summary judgment, Judge Paula Xinis ordered the government to file notice thirty (30) days in advance of any activation of the portal for the State Citizenship Lists. The order is a notice requirement: it does not stop DHS from building the lists, and no ruling on the motion appears in the records reviewed. DOJ’s later brief says the court noted at the hearing a tentative conclusion that the Supreme Court’s SAVE decision defeats the plaintiff’s statutory-authority claim.

Separately, DOJ told plaintiffs in the Washington cases that it intended to provide at least 48 hours of notice before the portal goes live. The Xinis order is the longer commitment.
