DHS Moves to Lift the Abeyance and Have the Court Decide the States' Motion to Quash the AAMVA Subpoena

The Department of Homeland Security moved to lift the order of abeyance in the E.D. Va. case on the States’ motion to quash its AAMVA subpoena, and asked the court to decide that motion; the docket entry is dated 09/25/2026. The abeyance is the one described in 2026-08-13–23-states-move-to-quash-hsi-aamva-cdlis-subpoena-judge-trenga-holds-motion-in-abeyance-aug-20.

The Movant States asked the court to deny Respondent’s motion to lift the order of abeyance, in a filing marked 10/09/26. The States wrote that the federal government’s filings “strongly suggest that the federal government is trying to evade the relief that this Court ordered,” and asked that the abeyance continue until the status of the 2026-09-17–judge-trenga-enjoins-aamva-from-transferring-state-cdlis-records-to-any-federal-agency injunction is secure.
