Reuters Review: DOJ Has Charged About 20 People This Month Under the "Voting by Aliens" Statute, Roughly 13% of All Prosecutions Under It; DOJ Spokesperson Counts 32 in Four Weeks

Reuters reported on Sept 23, 2026 (publication date) that the Justice Department had brought criminal charges against about 20 people that month under the “voting by aliens” statute, roughly 13% of all prosecutions brought under it since it was enacted three decades ago, by a Reuters review of court records and government statements. Separately, a DOJ spokesperson told Reuters the department had charged 32 people in the last four weeks for noncitizen voting and related offenses.

Reuters attributed “tier-one priority for the attorney general and for the White House” to an unnamed Justice Department official, and reported that HSI has 1,600 open investigations on the issue and that its agents are mobilized in all 50 states. Seven of the 32 cases were brought by the Northern District of Texas U.S. Attorney’s Office, with help from Texas Attorney General Ken Paxton’s office. Reuters also reported, from a source briefed on the conversation, that a top DOJ official told senior prosecutors that prosecutors could no longer decide on their own to refuse election fraud cases.

A separate Reuters review published the same week found states may have added more than 30,000 self-declared noncitizens to voter rolls since 2000 because of software glitches and clerical errors.
