DSCC, DCCC, DGA, Schumer and Jeffries Sue to Bar Armed Federal Agents From November Polling Places
The Democratic Senatorial Campaign Committee, DCCC, DGA, Senate Minority Leader Chuck Schumer and House Minority Leader Hakeem Jeffries filed a lawsuit late Wednesday, September 23, 2026, asking a federal court to bar the Trump administration from deploying armed officers “in the vicinity of open polling places, including dropboxes, curbside voting locations” or anywhere votes are collected, counted, or certified — a request covering early voting through post-election ballot-curing, for the November 2026 midterms. Five days earlier, on Friday, September 18, 2026, the NAACP and eight other civil rights and labor organizations filed a separate suit against DHS, ICE, DOJ and the FBI alleging the same threatened deployment violates the Voting Rights Act, citing an immigration checkpoint federal agents set up on a road leading to a majority-Black-and-Latino Lee County, Florida polling precinct as evidence the threat is not hypothetical.
Both suits follow a documented pattern of brinkmanship rather than a reversal: Deputy AG Todd Blanche publicly endorsed deploying ICE agents to polling places in July without promising compliance with anti-intimidation law (2026-07-15–dag-blanche-endorses-ice-agents-polling-places-2026-midterms); LULAC, UnidosUS, Common Cause and Denver sued DHS over the same threat in September (2026-09-10–lulac-unidosus-denver-sue-dhs-armed-ice-polling-places); and FBI Director Kash Patel, under Senate Judiciary Committee questioning on September 15, declined to rule out agents at the polls (2026-09-15–patel-refuses-under-oath-rule-out-fbi-agents-polling-places-midterms). Two now-filed lawsuits in nine days mark the shift from advocacy-group litigation to the Democratic Party’s own national campaign committees and congressional leadership joining as plaintiffs — a different institutional weight than the September 10 suit, filed five weeks before the election it is trying to constrain.
