Michigan v. DHS (Romulus Warehouse): Court Stays the Case a Second Time, Sixty Days, While DHS Completes the GSA Excess Process

On 09/17/26 Judge Jonathan J.C. Grey (E.D. Mich.) entered an order staying State of Michigan and City of Romulus v. DHS, No. 2:26-cv-10968, for a further SIXTY DAYS. The stay rests on Defendants’ “intention to no longer convert the Romulus Warehouse into an immigration detention facility” and instead to designate it as excess property for disposition by the General Services Administration. The earlier stay was a stipulated order of July 7, 2026; the parties’ joint status report of September 8, 2026 asked for the extension.

The status report supplies the one dated step in the excess process the corpus did not have: Defendants “began the Report of Excess (ROE) process by uploading documents related to the property into the GSA ROE Portal on June 22, 2026,” and the process had still not been fully completed. The order continues the bar that Defendants “SHALL NOT take any action to convert the Romulus Warehouse into an immigration detention center during this stay.” The stay lifts when the next joint status report is filed or earlier on either party’s request.

This is the court-record counterpart of the offload reported in 2026-09-03–dhs-moves-to-offload-seven-ice-warehouses-pivots-to-shuttered-prisons: the case is neither dismissed nor decided, and the federal commitment not to convert the building is enforced only by a stay order that runs sixty days at a time.
