USCIS Swears It Has Shared No State Citizenship List Data With Any State; Placeholder Portal Page Was Live Since June 10
In declarations signed under penalty of perjury and filed in a Maryland federal case brought by the Electronic Privacy Information Center, a USCIS official stated: “To date, USCIS has not shared any data related to the State Citizenship Lists or Executive Order 14,399 with individual states”. An SSA official stated that SSA “has not sent any state citizenship list data to the Department of Homeland Security”. USCIS also said a “coming soon” page for the State Citizenship List Portal went live on June 10 and was removed on August 31, and stated: “This work is not complete, and no implementation date has been set”. DOJ’s later brief in the same case says that, as of September 10, none of the infrastructure the order called for within 90 days had been established.
The USCIS declaration also records what the Massachusetts judgment in the states’ case did in practice: DHS and USCIS “immediately stopped all work” on the lists for all states, not only the plaintiff states, until the Supreme Court order of August 24. That is the agency’s account of its own conduct, not a court finding. The June 30 operational date reported in 2026-06-04–dhs-approves-eo-14399-save-citizenship-lists-operational-june-30 was not met, and the order’s own transmission requirement of 60 days before the election had passed with nothing delivered.
