New York Times: Political Influencer Payments Fall Into a Legal Gray Area in 2026 Midterms
The New York Times reported on Aug. 30, 2026 (republished by The Philadelphia Inquirer) that political campaigns and outside groups are paying social media influencers for supportive posts, and that the messages “fall into a legal gray area”. Steyer’s campaign paid 17 influencers at least $5,000 apiece, including one, Carlos Eduardo Espina, who received a total of $400,000, campaign finance filings show; former Rep. Katie Porter paid influencers a total of $139,500. A Times analysis found that at least 87 people registered to work with the content platform SideShift had made posts backing Steyer or Stevens or joined a third campaign supporting Rep. James Talarico, and most of those posts included no acknowledgment that money changed hands.
The Times quotes emails from Activate HQ to a creator warning that “disclosure is not required and the paid partnership label will not be included in any posts”; the creator was told the money came from Majority Forward. Majority Forward told the Times that the email language explains FEC disclosure requirements, “which were fully followed.” The Times reports that there are no federal regulations requiring disclosure of payments for political support on social media, and that just four states have laws or regulations requiring influencers to disclose paid political messaging, but they apply only to state and local races, not federal contests.
Context: the paid-influencer pattern recurs in the corpus: 2026-03-13–democracy-unmuted-dark-money-1500-per-post-influencer-campaign-against-abughazaleh-anthes-advocators-upstart-factory-chain-exposed and 2026-10-01–jindal-founded-america-next-250k-influencer-marketing-ie-against-el-sayed-breakthrough-llc. This entry adds the Democratic-side money and the disclosure gap that lets both sides operate unlabeled.
