HSI Domestic Operations Broadcast to All Special Agents in Charge Launches Voter-Fraud Surge at AD Krol's Request; Now in the California Nurses Amended Record
The government’s own amended administrative record in California Nurses v. Mullin opens with an HSI broadcast message dated Friday, August 28, 2026, at 4:14:16 PM (the message’s own Date line), which sets the start dates of the voter-fraud surge that CNN reported days later. The amended record was filed 10/16/26 (the court’s filing stamp) as ECF 77-1. Its index lists the document as “08196-26 [BCAST] Voter Fraud Surge — Broadcast”, the cell wrapping onto a second line. The message’s own subject line, read from the page image, is the same title with a hyphen.
Who sent it, and who asked. The message says it is sent “At the request of Assistant Director Michael J. Krol, Homeland Security Investigations (HSI), Domestic Operations, the following message is being sent to all Special Agents in Charge.” Krol is named as the requester, not as a signer. The From, To and Cc lines are redacted, the message carries no signature, and it closes with an “HSI Domestic Operations” sender block whose contact lines are redacted. Who wrote or sent it is not shown on the page.
What it instructs. The message announces that “Beginning September 1, 2026, HSI will launch a coordinated Criminal Voter Fraud surge initiative to pursue investigative leads, conduct field interviews, and support timely prosecutorial review.” Each SAC office with leads “in the assigned state” is asked to take investigative action each day on a state schedule: Washington, Wisconsin, Missouri and Georgia starting September 1, 2026; California on September 7, 2026 and again on September 14, 2026; Pennsylvania on September 21, 2026. Further schedule lines are redacted. Offices “must coordinate with partner agencies as appropriate, refer prosecutable matters to the U.S. Attorney’s Office”, record findings in a redacted case system, and update the “Criminal Voter Fraud Initiative Portal”, which the message calls “a tracking and reporting tool only”. It lists case-coding fields, a list of federal statutes that it says is not exhaustive, and an instruction that “Field offices must coordinate any anticipated media or public messaging through their local Public Affairs Officer (PAO).”
What it is and is not. It is a document in the government’s own administrative record, so the government has put it before the Northern District of California as part of the record of the challenged action. The HSI “Election Integrity Investigations” update that follows it in the same record, and the surge it launches, are covered in 2026-09-01–dhs-hsi-voter-fraud-surge-nine-states-midterms; the government’s earlier account of the surge is in 2026-09-28–cna-v-mullin-government-says-hsi-surged-voter-fraud-investigations-after-uscis-leads. Whether this message is the internal guidance that the NAACP plaintiffs request is consistent with the descriptions but not established; see 2026-10-16–naacp-v-dhs-government-opposition-quotes-request-4-directives-plaintiffs-reply-says-defendants-do-not-deny-they-exist.
Sourcing note. Method: the court PDF was rendered to page images, OCR was run, and each quoted span was checked against the image by eye; the OCR text is archived beside the PDF in the research KB. The PDF’s only text layer is the court’s filing stamp, so the automated gate reads that stamp and nothing else on these pages. Dates here carry their kind: the message’s own Date line (dated) and the court’s filing stamp (filed).
