Elkhart Indiana Council Votes 9-0 to Stop Accepting Data-Center and Battery-Storage Applications Through 2027

The Elkhart, Indiana city council voted 9-0 on August 27, 2026 to suspend new applications for data centers and battery storage facilities through December 31, 2027, while the city develops regulations on noise, water use, and electricity demand. Dozens of residents spoke in favor, some calling for a permanent ban.

Two things distinguish this from the rest of the lane.

First, it covers battery storage alongside data centers. Those are different industries with different owners, and a council that pauses both is regulating a shared attribute — large industrial land uses that draw heavily on the grid and arrive through the same approval path. It is the same move Hall County, Georgia made when it paused data centers and detention centers together: the instrument does not care what the facility is for.

Second, the city had no pending projects. Indianapolis paused after three approvals and exempted all three. Elkhart paused before anything arrived, which is the only timing at which a moratorium costs a jurisdiction nothing and constrains nobody’s existing investment — and the only timing at which it can shape the first proposal rather than the second.

The residents asking for a permanent ban are worth noting against the Bulloch County, Georgia vote two weeks earlier, where commissioners rejected exactly that 4-3 while keeping a moratorium. Where a permanent ban has come to a vote in this timeline, it has not passed.

The ordinance text was not obtained. The capture also bundled in Florida’s SB 484 ratepayer-protection law as context; that is a separate state-level action and is not carried here, having not been verified in this pass.
