Emporia, KS Commission Sends Data-Center Ban Initiative to November Ballot After Court Order
The City of Emporia, Kansas reported on its news page that the Lyon County District Court ordered a citizen-initiated ordinance prohibiting high-impact data centers onto the November 2026 ballot. The city said placement of the question on the ballot “does not resolve the pending legal issues”.
Its commission then approved Resolution No. 3799, submitting the ordinance to the ballot on a special-meeting date the city’s release gives as August 26, 2026. The release says the ordinance “cannot be published or take effect until the pending legal questions are resolved or otherwise ordered” if voters approve it, so a yes vote does not by itself enact the ban.
