Judge Howell Orders ICE to Process 1,000 Pages/Month of Polling-Place FOIA Records

U.S. District Judge Beryl Howell on August 22 ordered ICE, DOJ, FBI, and DOD to process at least 1,000 pages per month of documents sought by the DNC in a FOIA lawsuit over potential federal agent deployment to polling places, drop boxes, and election offices ahead of November’s midterms. Howell called ICE’s projected June 2027 disclosure timeline “an unacceptable delay given the proximity of the 2026 midterm elections” — a schedule that would have completed production roughly seven months after the election it concerns. The order continues a monthly-processing requirement Howell first imposed in mid-July after the government reversed an earlier claim that no responsive records existed.

The production record so far is the sharpest fact in the ruling: of approximately 10,698 pages ICE identified as potentially responsive, the agency had produced only 576 pages — and those were press clippings, not the underlying records the DNC sought. At the original pace, more than 8,000 of those pages would have remained unreleased until after election day. The DNC filed the underlying FOIA suit in March 2026 against DOJ, DHS, and DOD; it has since asked Howell for even faster production, every two days, a motion DOJ opposes and that remains pending.
