ProPublica Reports DOJ Pressed U.S. Attorneys for Voter-Fraud Cases as Lutnick Claims 24,000 Noncitizens Voted

Two disclosures landed on August 20, 2026, describing the same effort from opposite ends. ProPublica, republished by the Minnesota Reformer, reported that Justice Department officials pressured U.S. attorney offices as early as late March 2026 to develop criminal voter-fraud cases substantiating the president’s claims that noncitizens vote in federal elections — pressing offices to produce prosecutions even where the local prosecutors reviewing the underlying records concluded the evidence was not there. The reporting describes urgency communicated down from Washington rather than cases arising upward from investigators, which inverts the ordinary sequence in which a prosecution follows evidence. Separately that day, Commerce Secretary Howard Lutnick released a report asserting that 24,000 noncitizens voted in the 2020 election, drawing on a Census Bureau analysis that stated the conclusion with “high confidence.”

Election-law experts rejected the 24,000 figure immediately and on methodological grounds. Marc Elias and Fair Fight’s Lauren Groh-Wargo characterized the report as a “bald-faced lie” — their words, not a finding of this record — and located the defect in two places: the analysis relied on an incomplete commercial voter file rather than official state registration data, and it matched records across datasets by a method that generates false positives when names and birthdates coincide. Experts quoted by Votebeat two days later added that the Census dataset used cannot distinguish a registration-file error from an actual ballot cast, and that the sample supporting the estimate is too small to carry the confidence level claimed for it. The government’s own prosecutors, per the ProPublica account, had reached a compatible conclusion five months earlier by looking for chargeable cases and not finding them.
