Colorado Issues Public Health Order 26-02 Compelling GEO Group to Surrender Aurora ICE Tuberculosis Records

The Colorado Department of Public Health and Environment issued State Public Health Order 26-02 on August 13, 2026, directing GEO Group to hand over tuberculosis records from the Aurora ICE Processing Center by August 17 or face legal action. The order followed the Adams County Health Department’s confirmation of an active TB case at the facility in June 2026 and a county-level order GEO had ignored for nearly two months. CDPHE demanded complete medical information for every individual with confirmed or suspected active TB from June 1, 2026 forward, a full list of people GEO identified as potentially exposed with relevant clinical information, and the dates, locations, and any cross-border notification efforts for the person diagnosed. The state’s press release characterized the escalation plainly: the order issued “after GEO Group refuses standard cooperation.”

The structural question is jurisdictional, not medical. A private contractor operating a federal immigration facility withheld communicable-disease records from both county and state public health authorities through a two-month exposure window — a direct test of whether ICE contractors can claim federal immunity from state health oversight.
