23 Movants File Rule 45 Motion to Quash HSI Subpoena to AAMVA (E.D. Va. 1:26-mc-00019); Judge Trenga Holds It in Abeyance Aug. 20 Citing the Companion DOT Case
On August 13, 2026 (filing date), Illinois, the District of Columbia, Virginia, California and 19 other movants (the caption lists 23, the last being the Governor of Pennsylvania) moved under Fed. R. Civ. P. 45 in the Eastern District of Virginia to quash HSI subpoena HSI-DC-2026-081167-001, described in the 2026-08-11–hsi-washington-dc-immigration-enforcement-subpoena-to-aamva-for-cdlis-pointer-records entry. The case is No. 1:26-mc-00019 (AJT-IDD), before Judge Anthony J. Trenga. The motion says DHS served the subpoena on AAMVA August 11 and demands “17 million State-owned records” by 8:00 a.m. Eastern on August 17.
The court entered an administrative stay on August 14 (ECF 19). DHS opposed (ECF 21), arguing that no pre-enforcement motion to quash lies against an 8 U.S.C. 1225(d) subpoena. After argument on August 20 (order date), the court vacated the stay and ordered that the motion “is held in abeyance and the time for the AAMVA to respond to the subpoena is CONTINUED, pending further order of the Court.” The order itself gives the reason: “issues raised in the Motion are related to unresolved issues and matters in” the companion case, Illinois v. U.S. Department of Transportation, 1:26-cv-2547. That is the court’s own stated link, not an inference.
As of the RECAP copy read (docket last filing Sept. 11, 2026, ECF 81), no ruling on the motion appears. RECAP holds only what someone has pulled from PACER, so a later order is not excluded. Nothing read shows AAMVA producing to HSI.
