ICE HSI Washington D.C. Issues 8 U.S.C. 1225(d) Immigration Enforcement Subpoena to AAMVA for Five Years of CDLIS Driver Records, Due Aug. 17

On August 11, 2026 (the date on the cover letter and the subpoena’s digital signature), the Homeland Security Investigations Special Agent in Charge office in Washington, D.C. (Reston, Va.) issued Immigration Enforcement Subpoena HSI-DC-2026-081167-001 to the American Association of Motor Vehicle Administrators (AAMVA), the nonprofit that runs the Commercial Driver’s License Information System (CDLIS) for the states. The form cites 8 U.S.C. 1225(d) and 8 C.F.R. 287.4. It asks for “all individual pointers” in CDLIS for the last five years: driver name, date of birth, state of record, license number and, if available, Social Security number. Production was due to an HSI criminal investigator by 8:00 AM Eastern on August 17.

The cover letter gives the purpose as investigating “illegal practices in commercial driver’s license (CDL) schools,” “criminal fraud regarding the issuance of CDLs to illegal aliens,” and “civil immigration enforcement.” The subpoena itself states no record count; the 17 million figure is the movant States’ description of its scope.

This was the second such demand. The States’ papers describe a first, in-person DHS subpoena served on AAMVA July 28 and then withdrawn; its number does not appear in the public record read for this entry. The same records had been demanded by the Federal Motor Carrier Safety Administration (FMCSA) on June 25. Whether the two federal demands were coordinated is a contested allegation in the litigation, not a finding; see 2026-09-17–judge-trenga-enjoins-aamva-from-transferring-state-cdlis-records-to-any-federal-agency.

Date kinds: Aug. 11 is the issue/signature date; the Aug. 13 filing date is when the subpoena became public record. Not shown in any record read: whether AAMVA produced anything.
