Judge Reyes Confirms Her Stay of Haiti TPS Termination Is 'No Longer in Effect' After D.C. Circuit Mandate, Denies Government Request to Halt Discovery in Miot v. Trump
Judge Ana C. Reyes (D.D.C.) signed an order on August 5, 2026 recording that her stay of the Haiti TPS termination “is no longer in effect”, after the Supreme Court reversed it and the D.C. Circuit sent the case back. The D.C. Circuit order said the case was “remanded to the district court for further proceedings consistent with the Supreme Court’s decision”.
The order “DENIES the Government’s request for a stay of discovery”. It also records that “Plaintiffs do not intend to file an amended complaint”. Remand therefore did not end Miot v. Trump: discovery and the merits go on.
USCIS states that “The Haiti TPS designation is terminated, effective July 27, 2026”.
