Trump Administration Races to SCOTUS Shadow Docket for Mail-Ballot Restrictions After First Circuit Upholds Block
The First Circuit upheld a block on Trump’s executive order directing USPS to compile voter eligibility lists and restrict mail-in ballot delivery, ruling the order would “sow confusion,” threaten disenfranchisement, and encroach on constitutional election authority reserved to states and Congress. Within 48 hours the Trump administration filed a Supreme Court emergency application — a shadow-docket maneuver aimed at installing the restrictions before November voter-registration deadlines, regardless of how the underlying litigation resolves.
This is the latest escalation in the mail-voting EO fight the timeline has tracked since the original order (2026-03-31–trump-executive-order-restricts-mail-voting-usps-voter-lists) and the 23-state suit against it (2026-04-03–23-states-sue-trump-mail-voting-executive-order), through Judge Talwani’s June injunction (2026-06-25–talwani-blocks-trump-mail-voting-eo-23-states-dc). The shadow-docket timing is itself the strategy: an emergency stay granted even pending full review would let the EO’s provisions take effect through the November midterms before final adjudication.
