N.D. Fla. Judge Wetherell Finds DHS 'Plainly in Violation' of the SAVE Settlement and Orders Bulk Upload and SSN Search Restored for Florida, Ohio, Indiana and Iowa, Disagreeing With the D.D.C. Vacatur
Judge T. Kent Wetherell II of the Northern District of Florida ruled for Florida, Ohio, Indiana and Iowa in their enforcement motion. The order says “Defendants are plainly in violation of the settlement agreement” because DHS disabled the bulk-upload and SSN-search features of SAVE. The operative paragraph orders DHS to comply “by reinstating Plaintiffs’ access to the bulk-upload and SSN-search features in the SAVE system.”
The features were switched off after the ruling in League of Women Voters v. DHS (D.D.C. June 22, 2026). The Florida order says “the Court disagrees with the conclusions in that order.” The parties’ status report says DHS told the states that the features were “restored for the Plaintiff States in this case (but not for any other SAVE users).”
No ISA or MOA appears in the docket.
