Otero County NM Renews 5-Year ICE Detention Contract Through 2031, Defying New Mexico's Statewide Detention Ban

Otero County, New Mexico renewed its Intergovernmental Service Agreement (IGSA) with ICE for a five-year term running March 2026 through March 2031, continuing to operate the Otero County Processing Center in direct defiance of New Mexico’s statewide prohibition on ICE detention contracts, which took effect in May 2026. Otero has been an ICE detention hub for over two decades and holds several hundred detainees; the renewal sets up a collision with state law that could trigger state enforcement action or litigation.

This follows the same defiance pattern as Torrance County, which extended its CoreCivic ICE contract just 12 hours after New Mexico’s Senate passed the underlying ban (2026-02-04–torrance-county-nm-corecivic-igsa-extension-12-hours-after-ban) — establishing a template of counties racing to lock in multi-year contracts before or in defiance of state prohibition. Whether the New Mexico Attorney General initiates enforcement against Otero is the test case for whether the state’s detention ban has teeth beyond the initial legislative win.
