Leaked Draft Resolution Reveals Board of Peace Seeking Sweeping Legal Immunity in Gaza

The Guardian obtained and reported on June 27-28, 2026 a leaked four-page draft resolution — “Resolution No 2026/3” — that would grant sweeping legal immunity to the Board of Peace and its affiliates operating in Gaza. The draft shields Board of Peace members, the Office of the High Representative (headed by Bulgarian diplomat Nickolay Mladenov), Palestinian technocrats, International Stabilization Force military personnel, and non-resident contractors from “any arrest, detention or legal proceedings in the courts or other entities in Gaza.” Trump, as board chair, would retain authority to waive an individual’s immunity with majority board approval. The draft’s Section 7 establishes an internal Board of Peace claims system to self-adjudicate compensation for property damage or personal injury arising from board operations, which international humanitarian law expert Emily Schaeffer Omer-Man told the Guardian amounts to an attempt “to exempt the board, and all of its personnel, from accountability for potential legal violations,” with “no external oversight, including applicable international law.” The draft separately empowers the board to occupy and use Gaza public property “needed for the accomplishment of the missions in Gaza” without a compensation requirement. Whether the immunity provision would extend to international courts (as opposed to only Gaza-domestic legal process) is explicitly unresolved in the Guardian’s own reporting.
