Filing date June 5; approval date June 4. In a notice filed June 5, 2026 in the consolidated DSCC v. Trump cases, DOJ told the court that on June 4, 2026, DHS had approved a USCIS recommendation on implementing Executive Order 14399, “including the creation of State Citizenship Lists”. In DOJ’s words, the first part was a SAVE-based State Voter Roll Verification “state election officials can submit their entire voter roll records” to SAVE. The second was a registry through which state election officials would access citizenship-related data from USCIS, the Social Security Administration and the State Department, with the data staying in each agency’s system. DOJ wrote that both parts were “proposed to be operational by June 30, 2026”.

Rescinded June 8. In a notice filed June 8, DOJ told the court that a new memorandum signed that day by Secretary Mullin “rescinds and supersedes the recommendation approved on June 4, 2026”. Of the SAVE voter-roll part, DOJ wrote that the order “does not direct that approach”. The replacement plan was for USCIS, with SSA and State, to deliver a mechanism for States to receive citizenship-related information by June 30, with citizen-facing portal capabilities phased in later in 2026.

What the order itself says. The order directs DHS to “compile and transmit to the chief election official of each State a list of individuals confirmed to be United States citizens”. The list runs from DHS to the states.

June 30 was missed. In a declaration executed on the 10th day of September 2026, USCIS swore that it “has not shared any data related to the State Citizenship Lists” with individual states.
