ICE and Clergy Coalition Agree to Daily Pastoral Access at Broadview for the Life of the Case

The Broadview clergy case moved from court orders to an agreement in mid-May. Magistrate Judge Laura McNally’s minute entry thanked the parties for a status report that sets forth an agreement for the Broadview facility to provide access to Plaintiffs during the pendency of this litigation absent agreement or further Court order. WTTW reported that the Coalition had reached an agreement with ICE and the Department of Homeland Security to allow daily pastoral visits inside the west suburban facility, and that visitations began last Friday.

What the agreement is and is not: it lasts only through the pendency of the litigation, which CSPL officials called not a permanent resolution, and the April injunction stays on the books. DHS’s public line is that Broadview is a processing center, not a detention center, where people are supposed to be held only briefly before transfer.

Where the case stands on the latest docket entries RECAP holds: it is in discovery, with fact discovery to close 2/1/27. By order dated September 1, 2026, Judge Gettleman denied the government’s motion to dismiss for the same reasons he granted the preliminary injunction, and directed an answer by September 29, 2026. No ruling on the government’s motion to alter the daily-access order appears in RECAP.
