Gettleman Orders ICE to Admit Clergy to Broadview Each Day of Holy Week; Government Filed No Response

Judge Gettleman granted in part the Coalition’s renewed motion for supplemental preliminary-injunction relief and ordered ICE to admit the plaintiffs to Broadview each day of Holy Week, Thursday April 2, 2026 through Sunday April 5, 2026, to offer services for those who desire them. The caption by then named Markwayne Mullin as the DHS defendant in place of Kristi Noem.

The court recorded that the defendants did not file a response to the motion, and again found a likelihood of success on the RFRA claim. It rejected the government’s argument that the plaintiffs’ exercise of religion was not substantially burdened because they could minister at permanent detention centers in other states. It also noted that the Ash Wednesday order had been successfully implemented without incident. The terms mirrored the Ash Wednesday visit, including a cap of four visitors.

The plaintiffs had asked for access twice daily for the life of the case. In a footnote the court said it did not reach that issue in this order; it did a week later, in the order that made access daily. The government’s later account of what the four Holy Week visits looked like is in the May motion to alter that order.
