NCRC and AFREF File OCC Comment Letters Opposing WLTC Trust Bank Charter

On February 9, 2026, the National Community Reinvestment Coalition (NCRC) and Americans for Financial Reform Education Fund (AFREF) both filed formal public-comment letters with the OCC opposing the WLTC Holdings, LLC application (OCC docket 2026-Charter-344521; regulations.gov docket OCC-2026-0100-0004) to establish World Liberty Trust Company, National Association.

NCRC’s letter raised eight grounds for opposition:

  1. Conflicts of interest — the applicant is co-founded by Trump family members and administration-proximate principals; the OCC is headed by a presidentially-removable official
  2. Lack of OCC authority — the proposed bank’s stablecoin-issuance and payments activities exceed the National Bank Act’s trust-charter scope, which should be limited to fiduciary activities
  3. Regulatory arbitrage — the structure grants banking credibility while avoiding FDIC deposit insurance and consolidated Federal Reserve holding-company supervision
  4. Lost Community Reinvestment — trust banks are not subject to Community Reinvestment Act obligations, potentially diverting billions from community development
  5. Consumer harm — a federal charter creates a false appearance of safety for uninsured stablecoin holders
  6. Weakened oversight — federal preemption displaces state-level consumer protections
  7. Safety and soundness risks — federal approval of weakly-regulated stablecoin activity increases systemic risk
  8. Premature issuance — NCRC urged a moratorium until GENIUS Act implementing regulations are finalized

NCRC also requested that the OCC extend the standard 30-day comment period for national trust applications to 90 days. AFREF filed a parallel comment letter the same day.

The comment letters constitute the formal civil-society record against WLTC’s application. Together with Senator Warren’s letters (2026-01-13–warren-presses-occ-halt-wlfi-bank-charter, 2026-01-23–occ-rebuffs-warren-wlfi-charter-delay), they position both legislative-branch and civil-society opposition on the OCC’s administrative record — relevant for any subsequent Administrative Procedure Act litigation.
