Judge Talwani stays the IRS-ICE address-sharing agreements
Holding (preliminary). In Community Economic Development Center v. Bessent, Judge Talwani ordered the IRS-ICE memorandum of understanding and related arrangements “stayed and preliminarily vacated” under the Administrative Procedure Act, and found that “relief is warranted to preliminarily enjoin ICE’s use of taxpayer addresses provided by IRS pursuant to the IRS-ICE MOU.” The court later described its own ruling as “finding it likely that IRS’s implementation of the IRS-ICE MOU violated 26 U.S.C. § 6103.”
Status. The government appealed the preliminary order as No. 26-1329, and the appeals docket says the case was “scheduled to be called for oral argument on Wednesday, October 7, 2026”. No appellate ruling appears in the mirror copy of that docket, whose newest entry is from mid-September.
