Attorney General's Memo Establishes the DOJ AI Litigation Task Force Required by the AI Preemption Executive Order

The memo, addressed to all Justice Department employees, is dated 2026-01-09 (the date on its face; the executive order’s deadline was thirty days after signing). It sets up the task force the order required and says the Associate Attorney General will serve as the Vice Chair, with the Attorney General or a designee as Chair. Members come from the Offices of the Deputy Attorney General, the Associate Attorney General and the Solicitor General, and the Civil Division, plus components the Attorney General later designates. It also repeats the order’s requirement to consult White House officials, including the Special Advisor for AI and Crypto, on state AI laws that may warrant challenge.

This closes a question the research file had held open: the task force was formally constituted, on paper, by the deadline. The Civil Rights Division is not on the memo’s named membership list, though it co-signed the later Colorado filing (2026-04-24–doj-complaint-in-intervention-pleads-only-equal-protection-no-task-force-no-preemption).

Read limit: the PDF is a scanned image read through OCR, and the signatory’s name did not OCR legibly. No name is asserted here.
