Judge Gettleman Issues TRO Ordering Minimum Conditions at ICE's Broadview Facility (Moreno Gonzalez v. Noem)

The complaint in Moreno Gonzalez v. Noem, a putative class action over conditions at ICE’s Broadview, Illinois facility, was filed on 10/30/2025 by the ACLU of Illinois, the MacArthur Justice Center and Eimer Stahl. It was assigned to Judge Robert W. Gettleman. Defendants include Secretary Kristi Noem, ICE’s Todd Lyons, Marcos Charles and Samuel Olson, and CBP’s Gregory Bovino.

On November 4, 2025, the court heard argument, and on November 5, 2025 it signed a temporary restraining order. It found serious conditions demonstrated to exist at Broadview and ordered defendants to provide, among other things, bedding, hygiene supplies, three meals a day, showers at least every other day, free private calls with counsel, and accurate detainee-locator listings. The order ran until November 19, 2025.

The same day DHS said the ICE Broadview Facility does NOT have subprime conditions, a statement that also referred to “an activist judge.”

Later docket (CourtListener/RECAP, checked this week; RECAP can lag PACER): preliminary-injunction hearings were stricken in March 2026 for settlement proceedings, and a May 2026 minute order says by agreement the TRO remains in effect until further order.

Amnesty is the pointer; the order and complaint are the sources.
