Judge Alexakis Orders CBP Agent Exum's Vehicle Returned from Maine After Government Released Evidence Out of State

U.S. District Judge Georgia Alexakis ordered CBP Agent Charles Exum’s white Chevrolet Tahoe — a key piece of evidence in the Marimar Martinez shooting case — returned to Chicago immediately via flatbed truck after defense attorneys revealed the government had released the vehicle from FBI custody and allowed Exum to drive it approximately 1,100 miles to his home state of Maine. On October 14, a CBP mechanic in Maine had attempted to remove scuff marks using brake cleaner on a shop rag. Prosecutors characterized the work as minor — “The mechanic did not repair any of the scratches or dents on the vehicle” — but the revelation shocked the court. Judge Alexakis stated: “I think you need to get the car back. It’s a reasonable request” and “There’s only so much you can tell from photos.” She added: “What gives me great pause is the fact the cars have been treated differently” — noting that Martinez’s vehicle and co-defendant Ruiz’s vehicle had been preserved in Chicago, while the government-agent shooter’s vehicle had been released cross-country. The vehicle was returned and defense attorneys inspected it on October 30. The unilateral evidence release — the government releasing the shooter’s vehicle before defense inspection — became a central issue in the eventual dismissal of charges against Martinez. The evidence-flight mechanism (releasing physical evidence to the shooter before independent inspection) is the Chicago analog to the investigative-jurisdiction-monopoly mechanism deployed in Minneapolis’s Renee Good and Alex Pretti cases.
